1. Background

Dapeng New District is located in the east of Shenzhen City, to the south of Pingshan, to the east of Yantian, and to the west of Huizhou. It faces the sea in three directions, separated from Hong Kong by the sea.  As a region boasting its unique and abundant coastal tourism and ecological resources owed to its relatively intensive historic & cultural resources with its largest scale, best preservation and most valuable ecological landscape in Shenzhen, Dapeng is expected to become a unique Card for Shenzhen and even Zhujiang Delta.

As the region with the most valuable ecological landscape resources in Shenzhen, Dapeng New District plays a more important role as the ecological Footstone of Shenzhen than its other role as a tourist resort , so the development of its ecological tourism should be initiated under enhanced protection. But at present, it is sort of lagging behind in development and much less popular than Xiaomeisha and Xunliaowan.

Planning is the antecedence to the development and construction of Dapeng New District. At the beginning of the foundation of the New District, the government of the New District commissioned Shenzhen Urban Planning & Land Development Research Center to formulate the Comprehensive Planning for Protection & Development of Dapeng New District.  As a development planning with a high starting point and standard, the Comprehensive Planning for Protection & Development of Dapeng New District comes up with the idea to form an urban construction blueprint of building both the city’s characteristic section of scientific development and a world-class coastal ecological tourist resort. Its objectives are as follows: strictly protecting the ecological environment, emphasizing high-quality development; vigorously implementing the Big Three Strategy of internationalization, high-end orientation and high quality; speeding up the construction of a world-class coastal ecological tourist resort, creating an ecologically biological peninsula, a life & health peninsula and an international tourism peninsula.

Leaders from municipal committee and government are very concerned with the development & construction of Dapeng Peninsula and had been there dozens of times to investigate and survey the construction of the New District. They thought highly of the current planning orientation and clearly expressed their request for speeding up the construction of a coastal tourist resort and achieving the goal of creating a world-class coastal ecological tourist resort by carrying out some specific projects.

2. Consultation Goals

With the Comprehensive Planning for Protection & Development of Dapeng New District as the guideline, we introduce a new international consultation system to attract concern and participation of the public; to widely collect design plans with advanced methods and technology; to provide more detailed proposals and operable industrial planning for the development & construction of a world-class coastal ecological tourist resort,which will be used as an important tool by the local government to regulate and control the whole development process of Dapeng New District in the years to come.

1)Evaluate and predict the bearing capacity of tourism environment, further coordinate the relationship between ecological conservation of Dapeng and tourism projects development, and integrate tourism development with environment protection from the beginning of development planning.

2)Locate and analyze the source of tourists, take full advantage of the natural and humanistic resources of Dapeng New District and design distinctive local products with an international standard for tourists all over the world.

3)Study the existing industry foundation, arrange the structure for tourism elements, develop new industries, and come up with principles & requirements for the layout of supporting facilities after the perfection of industry layout.

4)Take every index required for the development and design of the land use for tourism and the landscape pattern of the area into consideration, ensure that the planning scheme can effectively guide the subsequent development & construction of the area.

5)Come up with effective policy guarantee measures; study and perfect such innovative policies as policies for industry development, policies for ecological compensation,policies for land use,  policies for financial & tax support and policies for development & encouragement.

3. Consultation Procedures & Rules

1) This consultation accepts registration globally. Consortium is allowed and no qualification limit is set.

2) Pre-qualification of all applicants will be carried out to finalize 5 consultancies or consultation consortiums as invitees to participate the consultation activities, and 2 other consultancies will be chosen as backups in case one of the above-mentioned invitees drops out.

3) For those who participate in the consultation activities as consortiums, each Party of the consortium shall sign the Consortium Agreement and submit it to the organizer along with other registration documents. Each Party of consortium shall not take part in the consultation activities in its own name or combine any other consultancy to form a consortium for such above participation. If the consortium is awarded the consultation agreement, each Party of consortium shall sign the Joint Consultation Statement, and one party should be designated as the leader for the consultation activities and make sure each Party knows specifically what their part of the job is and gets it done collectively.

4) Each stage of consultation activities will be proceeding in the form of reporting and open to the public. One winner will be determined by votes in each stage of consultation activities, and the winner will compile a subject report of this stage.

4. Requirements & Registration Documents

1) Both domestic and foreign consultancies are entitled for registration while individuals and groups are not.

Domestic and foreign planning & design institutions, ecological protection agencies, travel planning agencies, tourism development agencies and policy research institutions are encouraged to register.

2) Registration documents shall include:

●Registration form (see the attachment)

●Profile of the consultancy and its founder, description of achievements and certificates

●Copies of business license/qualification certificates (or commercial registration certificate) (with official seal or signature)

●Consortium Agreement (refer to the annex for its format)

3) Applicants shall submit to the organizer the above-mentioned documents required for registration (one electronic copy, one hard copy) before the deadline.

4) Consultants involved in the consultation activities shall be registered with their consultancies, and the project chief shall be directly involved in the whole process of design and consultation.

5) Within 3 days from its receipt of Invitation for Competition, the invited consultancy shall enter into the Agreement with the undertaker for International Consultation on Tourism Development & Industry Planning of Dapeng New District in Shenzhen to confirm its participation in the competition. If the invited consultancies or consortiums give up their chances for participation, the sponsor will have the right to replace them with backup consultancies or consortiums according to their rankings from the pre-qualification result.

5. Rewards & Compiling Fees

1) Consultation rewards:

1st stage:   Not less than RMB 200,000 for Job Description & Technical Route

2nd stage:  Not less than RMB 300,000 for Bearing Capacity Research

3rd stage: Not less than RMB 300,000 for Orientation of Tourism Island

4th stage: Not less than RMB 300,000 for Portray of Tourism Island

5thstage: Not less than RMB 300,000 for Implementation of Tourism Island

The top scorer for each stage will be the stage winner, and be responsible for the compilation & completion of a Subject Report for that stage and receive a fee of not less than 30,000 RMB for its compilation work. If a dead heat happens, the expert judges will exchange their opinions and determine who undertakes the compilation work.

2) The top scorer with the highest score of 5 stages combined will be the chief coordinator for the international consultation, who will be responsible for the compilation & completion of the final outcome report. And the fee of not less than RMB 300,000 for the compilation of the final report will be distributed by the chief coordinator (refer to the documents for consultation agreement).

3) Taxes arising from above-mentioned rewards and compiling fees shall be borne by consultancies.

6. Pre-qualification

1) Committee for pre-qualification:  the department in charge of government planning invited 4 experts and 1 representative to form the committee for pre-qualification.

2) Committee for pre-qualification is presided by its director , who is elected by votes and enjoys the same right to vote as others.

3) Committee for pre-qualification will take into consideration the following 3 aspects for comprehensive review.

●Achievements of the consultancy company, especially relating to similar project experience.

●Consultancy companies with relative project experience in the scope of study.

●The consulting team, and the specialty and professional experience of the members

●Structure of consultancy team and specialties & career experience of team members

7. Principles for Appraisal

1) Review committee for each stage:  the department in charge of government planning invites 4 experts and 1 representative of sponsor to form the review committee. Its members are required to have such specialty backgrounds as planning & urban design, a

In compliance with relative laws & regulations of the Nation and Shenzhen, and

In compliance with requirements from the consultation specification.

8. Agenda & Schedule

All time as below is subject to Beijing Time.

●Schedule for registration & consultation:  from 09:00, 15th Jul. 2013 to 17:00, 29th Jul. 2013.

All applicants shall submit their registration documents to the organizer before the deadline date (address: 1/F, Guihua Building, 8009# Hongli West Road, Futian District, Shenzhen;  Receiver: Shenzhen Urban Design Promotion Center,  Zip Code: 518034),  The actual receipt date shall prevail.

● Date of pre-qualification:  preliminarily set on 31st Jul. 2013

●Release of pre-qualification result: preliminarily set on 1st Aug. 2013

●Site reconnaissance: preliminarily set on 5th Aug. 2013

●Deadline date for submission of consultation results: in principle 30 days for each stage, design period of 15 days, 15 days for integration of later schemes.

Consultancy institutes participating in the competition should submit the final consultancy results to the specified address (which will be otherwise specified) before the deadline date, and actual receipt date will prevail. Overdue submission will be deemed as renunciation and prohibit any access to the subsequent activities.

9. Result Requirements

1) The submitted documents for consultancy results must comply with the Chinese and Shenzhen’s regulations related to urban planning and design and satisfy the Result Requirements and requirements for Result Type with complete, legible and accurate expression.

2) Each consultancy institute (whether individual or consortium)is allowed to submit only one design scheme.

3) All documents for consultancy results must be submitted simultaneously and the organizer will issue receipt verification.

10. Validity of Result Documents

If the documents for consultancy results are deemed by two thirds of review committee members as one of the following cases, then the documents will be deemed as invalid (invalid consultancy documents will be withdrawn by consultancy institutes themselves within 10 days after receipt of notices; invalid consultancy documents which are not withdrawn in valid period will be disposed by the sponsor).

1) Failure to sign the Agreement for International Consultancy on Tourism Development & Industry Planning of Dapeng New District of Shenzhen.

2) Participation in the consultancy activities as consortium and failure to submit the Joint Consultancy Statement; changes happen to the consortium after passing the pre-qualification.

3) Participants specified in documents for consultancy results are substantially different from applicants for pre-qualification in terms of name and organization structure.

4) Overdue submission of documents for consultancy results.

5) The contents of documents for consultancy results are altered after submission.

6) Failure to submit the right documents and failure to respond to the material requirements and conditions from Consultancy Task Book, and failure to be approved by the Review Committee.

7) The documents for consultancy results are not originally created, or has been published , or is verified to be similar with other design schemes by over 2/3 of members of the Review Committee.

11. Copyright and Related Legal Issues

1) The right of authorship of all submitted documents for consultancy results is owned by the participants.

2) The sponsor and organizers are entitled to freely use all documents for consultancy results for publication and exhibition, and introduce, appraise the documents for consultancy results through media, professional magazines, books or other forms. All participants enjoy the right to signature for submitted documents for consultancy results.

3) All submitted documents for consultancy results should be originally created by participants, and are forbidden to cover any material infringing the intellectual property right of any third party. Otherwise, the entitlement of participants relating to infringing acts will be abolished and the participants in question should bear all consequences of infringement.

4) All basic documents provided by the organizer to participants (including texts, drawings and electronic data) are exposed to copyright protection. Without authorization, any person is forbidden to duplicate, amend, distribute, disclosure, lend or transfer the concerned contents, otherwise, he will assure concerned legal liabilities.

5) Governing laws: This international consultation is governed by laws of the People’s Republic of China. All activities and documents apply the laws of the People’s Republic of China.

12. Others

1) All documents relating to the consultancy activities are in Simplified Chinese. When other languages are applied, the Chinese version will prevail.

2) The organizer reserves the right to amend the agenda and he will notify the participants 5 days in advance for any change.

3) The consultancy institutes participating in the consultancy activities shall be deemed to have accepted all contents of this document and agree to be bound by this document.

4) The sponsor is responsible for interpreting this Consultation Document.
