1. Project Name and Background

This tender mainly focuses on the schematic design for the mixed use development for CITIC Securities headquarter which to be erected in Shenzhen.

4. Tender Purpose

The purpose of this international design tender is to seek a high-end iconic HOPSCA scheme to represent the advance corporate image as well as predominant position of CITICS in securities industry.

5. Design Basis

(1)Current related laws, regulations and standards of Shenzhen municipality, Guangdong Province and China;

(2)Existing related planning in the area concerned (Refer to background documents and appendix drawings)

(3)Design Brief for CITIC Securities Headquarter Development in Shenzhen.

6. Requirements for Tenderers

(1)The domestic or joint design consortium applicant must hold China's Grade A design qualification of architectural and engineering industry or above. For oversea applicant or their wholly-owned subsidiary, the above requirement is not applicable but it shall be a legally registered entity with continuing corporate capacity which is engaged in architectural and engineering design business. 

(2)Architectural design experience of high rise office buildings no less than 300 meters in height during recent 5 years is prerequisite for all tenderers or joint consortiums. Design experience of 5-star hotel would be bonus and considered with priority.  The above design experience including schematic design, detail development design and construction design while concept schematic design does not count.

(3)The applicants shall submit the sign-up documents (1 CD and 1 hardcopy document included) according to the competition files to the organizer before the deadline.

(4)Sign-up documents include:

◆Sign-up Form (see the attachment)

◆Brief introduction of the organization, related achievement and official reference (with supporting documents of the design experience as stipulated in the above clause no.2 including relevant contract pages, project and client’s basic information, etc.)

◆Photo copy of Business License/Qualification Certificate (or Business Registration Certificate) (official stamped or signed)

◆Joint Tender Agreement (see the attachment),if applicable.

◆Composition of the Design Consortium shall include: how the work scope, interests and responsibilities are divided and signed to each member, organization chart of design team, design experience & job reference of each member respectively.

◆Work Program: work schedule on the team member list, cooperation mode, design phases and etc.

◆Quotation List: quotation scope in relation to various program and basis for each phase. (see the attachment).

(5)Designers participating into this tender must come from headquarters of the tenderer. The chief designers must be those who have presided over many similar design projects and will directly take part in the whole design process. Social insurance payment certificate for the recent year should be provided for major designers of domestic tenderer.

7. Tender Rules

(1)The tender shall be open tender for worldwide tenderers.

(2)The organizer shall conduct prequalification assessment as soon as all the sign-up files were received. 5 tenderers will be selected via the pre-qualification assessment and 3 more for backup in case any invited organization quit, the backup ones will join in order.

(3)The tenderer will receive the Confirmation letter for qualified tenderer issued by the organizer within 3 working days after the pre-qualification assessment to confirm the participation and kick-off the design works.

(4)1 design scheme should be provided by each tenderer.

(5) The jury will select top 5 schemes and the tenderer of winning scheme will be awarded with the design contract in principle. The organizer will have business negotiation base on the appraisal result of the jury, budget and technical aspects to decide the final winner of this tender and commission the subsequent design contract regarding the schematic design and detail development design of architectural trade.

(6)For tenderer of design consortium, each member in the consortium should sign a Joint Tender Agreement, and hand in with other required sign-up documents. Member in any design consortium CAN NOT participate the tender independently or be any other consortium’s member. If a design consortium wins the contract, members should sign a Joint Design Declaration, which includes the contents of who the lead architect is, how the work scope, responsibilities and fees are divided and assigned for each member. The declaration will form part of the contract.

8.  Appraisal Manner

(1)The prequalification assessment is expected to be completed by April 19th, 2014 which should subject to the receipt of confirmation document issued by the organizer. 5 tenderers and 3 backups are to be selected by open vote and detail as follows:

The urban planning department will invite 5 experts to form the prequalification committee with 2 representatives of the organizer. Registration documents of tenderers will be examined and ranked base on past performance and preliminary concept sketches, if applicable, by open vote. 5 invited tenderers will be selected with another 3 backups, which will substitute in order in case there’s decline from the invited tenderers. Those tenderers who passed the prequalification but without invitation could still participate in the tender and submit final deliverables and enjoy the same opportunity in final appraisal, except they won’t be entitled for the minimum compensation fee as prescribed in the tender documents.

Corporate Qualification

Chief Designer’s Qualification

PRC 1st class registered architect qualification for domestic tenderer and AIA or equivalent qualification for oversea tenderer shall be pre-requisite. Priority shall be granted for those who made extraordinary contribution in the field of super high-rise building design.

Relevant design experience

Architectural design experience of high rise office buildings no less than 300 meters in height during recent 5 years is prerequisite for all tenderers or joint consortiums. Design experience of 5-star hotel would be bonus and considered with priority.  The above design experience including schematic design, detail development design and construction design while concept schematic design does not count.

Prequalification procedure:

Preliminary checking: The committee will conduct preliminary checking for the registration and prequalification documents according to the above requirements. The committee may request tenderer to supplement supporting documents for verification.

Detail checking: The committee will conduct detail checking for those tenderers who passed the preliminary checking according to above requirements. Tenderers who fail in detail checking will be disqualified before voting stage.

Besides the above requirements, tenderer could only enter into voting stage with neither of the following occasions:

- fails to clarify or provide supporting documents as per request of prequalification committee

- practice fraud, bribery, behave illegally or any conduction that offense the law

During the prequalification assessment, the committee could issue written request to any tenderer for necessary clarification to the ambiguity in the submitted documents. The reply of tenderer shall be in written and no material change will be allowed to be made to the submitted documents. The reply and supplementary information provided by the tenderer shall form part of the registration and prequalification documents. Voluntary clarification and supplement initiated by tenderer will not be accepted.

Voting Manner:

-  If the number of approved tenderers is between 3 to 5 after the detail checking, all approved tenderers will be deemed passing the prequalification without further voting.

-  If the number of approved tenderers is over 5, the committee will conduct open vote to rank the tenderers. In case of equal votes, additional rounds of voting will be conducted until the ranking is determined.

-  The organizer will notify the top 8 tenderers according to the prequalification result and the top 5 will enter the tendering stage directly. The 3 backup candidates shall substitute in order in case there’s a decline.

(2)The manner of closed bid will be applied in appraisal, namely, the experts don’t know the relationship between tenderer and design documents.

(3)The panel of jury would be comprised by national academician, design masters and domestic/international famous experts including experts major in urban planning, architecture, building structure, building services and construction, etc.

(4)Deadline of tender submission is expected to be May 29th, 2014 while the final appraisal is scheduled in mid June and the top 5 schemes will be selected and announced afterwards.

(5)The organizer will notify tenderers via E-mail or fax once the aforesaid agenda changes.

9. Requirements for Design Documents

(1)The design documents must comply with provisions of related urban planning and design standards of the People’s Republic of China and Shenzhen, tally with the detail requirements in Tender Document for the contents with complete, legible and accurate expression

(2)The original design documents must be stamped and signed by the related tenderers. Name and signature of the chief designer and official stamp of design organization should be marked at the right bottom corner on the back cover of the brochure. The same shall be marked on the right bottom corner on back side of all display panels. The marking size is 80mm (width) *60 mm (height) and to be sealed with non-transparent paper. Name of author or organization are prohibited to appear at anywhere else and other copies

(3)Except for the aforesaid positions, the design submission should NOT be marked, signed or implied the identity of authorship in order to ensure the fairness of accreditation.

(4)All design documents must be submitted in one-time.

10. Validity of Design Documents

(1)Design documents must be submitted before deadline and meet with all requirements in the competition documents. Design submission will become invalid in case any of the following occurs.

◆Overdue to submit design documents or don’t submit design documents in one-time;

◆The contents of design documents are altered after submission;

◆Signature or stamp are found missing on design documents in accordance with relevant requirements

◆The design documents which express or imply the identity of tenderer;

◆Design documents which don’t comply with requirements in the design brief or incomplete submissions or produced in a rough way.

◆The design scheme is not originally created, or has been published, or is affirmed to be similar with other design schemes by over 2/3 of members of the expert jury panel.

◆The design document is found being subcontracted to or privately consigned to other designers or design organizations.

(2)The organizer will not pay the minimum compensation fee and travel expense compensation for disqualified design schemes.

(3)The invalid design documents will be kept for 10 days for collection by relevant tenderer after the appraisal. The invalid design documents which are not collected after the above period will be disposed by the organizer.

11.  Agenda

Beijing time is applied for the agenda.

(1)Deadline of signing up: 13:00 p.m., April 3rd, 2014. Tenderers are required to submit the registration documents to the organizer before deadline .The actual receiving date will prevail.

(2)Announcement of the prequalification assessment result is expected to be on April 9th, 2014. The organizer will issue Confirmation Letter for Qualified Tenderer to the tenderers passing the prequalification via E-mail or fax.

(3)The organizer shall arrange the design kick-off meeting on April 14th 2014 at conference room on 15/F Shuguang Mansion, No.12 Keji South Road, Nanshan District, Shenzhen. Site visit will be arranged afterwards and the detail schedule will be noticed later.

(4)Deadline for submission: all submissions should be delivered to the designated address before 13:00 p.m. on May 29th, 2014. The actual date receiving the final submission will prevail. Those overdue will be regarded as waiver and will become invalid that would not be allowed to participate in the subsequent review and assessment.

(5)The organizer is expected to issue notice of final expert appraisal via E-mail or fax on June 4th, 2014 to the tenderers. Expert appraisal is expected to be held on June 13th 2014 and venue to be confirmed.

(6)The appraisal results is expected be announced in June 2014 via E-mail or fax and be publicized online.

12. Compensation and Related Expenses

(1)Minimum compensation fee: those tenderers who submitted valid drawings and documents etc. that fulfilling all competition requirements can get minimum compensation fee according to the following standard:

1st prize: 500,000 RMB

2nd & 3rd prize: 400,000 RMB respectively

4th & 5th prize: 300,000 RMB respectively

Additional travel compensation fee would be considered for oversea tenderers which subject to the agreement between tenderers and the organizer. However such travel compensation would not be entitled to those oversea tenderers whose major designers are living or working in China.

(2)Compensation fee will be paid after the result announcement being issued. The organizer will sign agreements with the top 5 tenderers regarding the details of payment.

(3)Taxes levied on the aforesaid minimum compensation fees shall be borne by the tenderer. Except for those agreed amount of travel compensation, any additional travel or design expense of tenderer should be borne by the tenderer as well.

(4)The final winner will be awarded with the Design Contract and relevant minimum compensation and travel expense will be part of the design fee that to be deducted in the first payment.

13. Tender Scope and Quotation

(1) Contract scope for the winner of this tender shall include the schematic and detail development design of architectural trade. The organizer shall sign the subsequent design contract with the winning tenderer after business negotiation on the basis of relevant domestic design fee and professional standard.

(2) For the quotation format, please refer to Appendix-4. The file shall be signed and stamped by the tenderers and be delivered to the designated address together with the submission package (detail requirements referring to the Design Brief) by the deadline.

14. Related Legal Issues

(1)The right of copyright of all proposals is owned by the tenderers. But the design documents will not be returned to the designers after appraisal.

(2)The client and the organizer are entitled to apply the design proposals and publicly display results after appraisal, introduce and appraise design proposals through media, professional magazines, books or other forms in relation to the project and be free of charge.

(3)All design schemes must be originally created by the concerned tenderers and are forbidden to cover any material infringing the intellectual property right of any third party. Otherwise, the infringing design organizations will be disqualified immediately from the tender and be liable for any implication so occurred.

(4)All basic documents provided by the organizer to tenderers (including texts, drawings and electronic data) are under copyright protection. Without authorization, any person is forbidden to duplicate, amend, distribute, disclose, lend or transfer any part of the concerned contents and otherwise, he will assume concerned legal liabilities.

(5)Notarization: This international tender will comply with the principle of openness, fairness and justness to ensure legality and justness

(6)Governing laws: This international tender is governed by laws of the People’s Republic of China. All activities and documents are applicable to laws of the People’s Republic of China. If negotiation fails for any dispute, both parties agree to submit it for the prosecution by the local court of the organizer.

(7)Confidentiality: The organizer will keep the design schemes received secret. Without the permission of the organizer,any person or institution is forbidden to disclose, publicize or display the design schemes before the accreditation is completed. Otherwise, he will bear related legal liabilities.

(8)In case any fraud, additional conditions, inconformity regarding the prequalification requirements was found that do not fully respond to the material content and requirements of the tender documents before the formal design contract signature between the organizer and the tenderer, the organizer reserves the right to void the validity of tender result and disqualify the tenderer.

16. Language and Others

(1)Standards for Language and Time

All documents in this tender should be written in both Simplified Chinese and English. If there is divergence when both Simplified Chinese and English are applied, the Chinese version will prevail.

Beijing time will be applied for the agenda.

(2)The organizer reserves the right to amend the agenda and will notify the tenderers timely 1 week in advance once the agenda is amended.

(3)Commitments of both parties

All tenderers of this international competition will be regarded to confirm all contents herein.

The organizer reserves the right for the interpretation of the tender documents.

Winner of the tender should ensure their principals and major designers to participate throughout the contract period. Oversea companies must ensure their design schemes must be signed and stamped by oversea staffs and offices.
